The Honorable S. James Otero of the United States District Court for the Central District of California appointed the Mauriello Law Firm as interim class counsel on behalf of consumers in a consolidated class action litigation against Best Buy. Sean Gass v. Best Buy Stores, L.P., Case No. 11- CV 11-01507 SJO (JCGx)(U.S.D.C. C.D. Cal.) Stonebarger Law, PC was appointed co-interim class counsel along with Mauriello Law Firm.
The plaintiffs allege that Best Buy violated the Song Beverley Credit Card Act, which generally prohibits businesses from requesting that cardholders provide “personal identification information” during credit card transactions and then recording that information. See Cal. Civ. Code, § 1747.08. Plaintiffs will be filing a consolidated complaint by October 18, 2011. Although no class has yet been certified, Plaintiffs’ motion for class certification is scheduled to be heard on February 6, 2012. A trial date is set for August 3, 2012.
